1.2relating to occupations; regulating athletic trainers;amending Minnesota Statutes
1.32012, sections 148.7802, subdivisions 3, 9; 148.7803, subdivision 1; 148.7805,
1.4subdivision 1; 148.7808, subdivisions 1, 4; 148.7812, subdivision 2; 148.7813,
1.5by adding a subdivision; 148.7814; repealing Minnesota Statutes 2012, sections
1.6148.7808, subdivision 2; 148.7813.
1.7BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.8    Section 1. Minnesota Statutes 2012, section 148.7802, subdivision 3, is amended to read:
1.9    Subd. 3. Approved education program. "Approved education program" means
1.10a university, college, or other postsecondary education program of athletic training
1.11that, at the time the student completes the program, is approved or accredited by the
1.12National Athletic Trainers Association Professional Education Committee, the National
1.13Athletic Trainers Association Board of Certification, or the Joint Review Committee on
1.14Educational Programs in Athletic Training in collaboration with the American Academy
1.15of Family Physicians, the American Academy of Pediatrics, the American Medical
1.16Association, and the National Athletic Trainers Association a nationally recognized
1.17accreditation agency for athletic training education programs approved by the board.

1.18    Sec. 2. Minnesota Statutes 2012, section 148.7802, subdivision 9, is amended to read:
1.19    Subd. 9. Credentialing examination. "Credentialing examination" means an
1.20examination administered by the National Athletic Trainers Association Board of
1.21Certification, or the board's recognized successor, for credentialing as an athletic trainer,
1.22or an examination for credentialing offered by a national testing service that is approved
1.23by the board.

2.1    Sec. 3. Minnesota Statutes 2012, section 148.7803, subdivision 1, is amended to read:
2.2    Subdivision 1. Designation. A person shall not use in connection with the person's
2.3name the words or letters registered athletic trainer; licensed athletic trainer; Minnesota
2.4registered athletic trainer; athletic trainer; AT; ATR; or any words, letters, abbreviations,
2.5or insignia indicating or implying that the person is an athletic trainer, without a certificate
2.6of registration as an athletic trainer issued under sections 148.7808 to 148.7810. A student
2.7attending a college or university athletic training program must be identified as a "student
2.8athletic trainer." an "athletic training student."

2.9    Sec. 4. Minnesota Statutes 2012, section 148.7805, subdivision 1, is amended to read:
2.10    Subdivision 1. Creation; Membership. The Athletic Trainers Advisory Council
2.11is created and is composed of eight members appointed by the board. The advisory
2.12council consists of:
2.13(1) two public members as defined in section 214.02;
2.14(2) three members who, except for initial appointees, are registered athletic trainers,
2.15one being both a licensed physical therapist and registered athletic trainer as submitted by
2.16the Minnesota American Physical Therapy Association;
2.17(3) two members who are medical physicians licensed by the state and have
2.18experience with athletic training and sports medicine; and
2.19(4) one member who is a doctor of chiropractic licensed by the state and has
2.20experience with athletic training and sports injuries.

2.21    Sec. 5. Minnesota Statutes 2012, section 148.7808, subdivision 1, is amended to read:
2.22    Subdivision 1. Registration. The board may issue a certificate of registration as an
2.23athletic trainer to applicants who meet the requirements under this section. An applicant
2.24for registration as an athletic trainer shall pay a fee under section 148.7815 and file a
2.25written application on a form, provided by the board, that includes:
2.26(1) the applicant's name, Social Security number, home address and telephone
2.27number, business address and telephone number, and business setting;
2.28(2) evidence satisfactory to the board of the successful completion of an education
2.29program approved by the board;
2.30(3) educational background;
2.31(4) proof of a baccalaureate or master's degree from an accredited college or
2.32university;
2.33(5) credentials held in other jurisdictions;
2.34(6) a description of any other jurisdiction's refusal to credential the applicant;
3.1(7) a description of all professional disciplinary actions initiated against the applicant
3.2in any other jurisdiction;
3.3(8) any history of drug or alcohol abuse, and any misdemeanor or felony conviction;
3.4(9) evidence satisfactory to the board of a qualifying score on a credentialing
3.5examination within one year of the application for registration;
3.6(10) additional information as requested by the board;
3.7(11) the applicant's signature on a statement that the information in the application is
3.8true and correct to the best of the applicant's knowledge and belief; and
3.9(12) the applicant's signature on a waiver authorizing the board to obtain access to
3.10the applicant's records in this state or any other state in which the applicant has completed
3.11an education program approved by the board or engaged in the practice of athletic training.

3.12    Sec. 6. Minnesota Statutes 2012, section 148.7808, subdivision 4, is amended to read:
3.13    Subd. 4. Temporary registration. (a) The board may issue a temporary registration
3.14as an athletic trainer to qualified applicants. A temporary registration is issued for
3.15one year 120 days. An athletic trainer with a temporary registration may qualify for
3.16full registration after submission of verified documentation that the athletic trainer has
3.17achieved a qualifying score on a credentialing examination within one year 120 days after
3.18the date of the temporary registration. A temporary registration may not be renewed.
3.19(b) Except as provided in subdivision 3, paragraph (a), clause (1), an applicant for
3.20a temporary registration must submit the application materials and fees for registration
3.21required under subdivision 1, clauses (1) to (8) and (10) to (12).
3.22(c) An athletic trainer with a temporary registration shall work only under the
3.23direct supervision of an athletic trainer registered under this section. No more than four
3.24 two athletic trainers with temporary registrations shall work under the direction of a
3.25registered athletic trainer.

3.26    Sec. 7. Minnesota Statutes 2012, section 148.7812, subdivision 2, is amended to read:
3.27    Subd. 2. Approved programs. The board shall approve a continuing education
3.28program that has been approved for continuing education credit by the National Athletic
3.29Trainers Association Board of Certification, or the board's recognized successor.

3.30    Sec. 8. Minnesota Statutes 2012, section 148.7813, is amended by adding a subdivision
3.31to read:
3.32    Subd. 5. Discipline; reporting. For the purposes of this chapter, registered athletic
3.33trainers and applicants are subject to sections 147.091 to 147.162.

4.1    Sec. 9. Minnesota Statutes 2012, section 148.7814, is amended to read:
4.2148.7814 APPLICABILITY.
4.3Sections 148.7801 to 148.7815 do not apply to persons who are certified as athletic
4.4trainers by the National Athletic Trainers Association Board of Certification or the board's
4.5recognized successor and come into Minnesota for a specific athletic event or series of
4.6athletic events with an individual or group.

4.7    Sec. 10. REPEALER.
4.8Minnesota Statutes 2012, sections 148.7808, subdivision 2; and 148.7813, are
4.9repealed.
