1.1A bill for an act
1.2relating to state government; requiring state funds used for state-funded
1.3projects to use state or American-made goods;proposing coding for new law
1.4in Minnesota Statutes, chapter 16A.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. [16A.058] USE OF STATE FUNDS.
1.7(a) Any funds from the state treasury appropriated or otherwise made available for a
1.8state-funded project must require that all of the iron, steel, or manufactured goods used in
1.9the project are produced in the United States.
1.10(b) The requirement in paragraph (a) shall not apply if the head of a state department
1.11or agency determines that:
1.12(1) the iron, steel, or manufactured goods needed for the project are not produced in
1.13this state or the United States in sufficiently available quantities and are not of satisfactory
1.14quality; or
1.15(2) use of iron, steel, or manufactured goods produced in this state or the United
1.16States will increase the cost of the overall project by more than ten percent.
1.17(c) If the head of a state department or agency determines that it is necessary to
1.18waive the application of paragraph (a) based on one of the criteria in paragraph (b), the
1.19department or agency head must notify the chairs and ranking minority members of the
1.20house of representatives and senate committees with jurisdiction over state appropriations.
