1.1A bill for an act
1.2relating to public safety; extending the time period for a continuance without
1.3adjudication in a juvenile delinquency case;amending Minnesota Statutes 2010,
1.4section 260B.198, subdivision 7.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. Minnesota Statutes 2010, section 260B.198, subdivision 7, is amended to
1.7read:
1.8    Subd. 7. Continuance. When it is in the best interests of the child to do so and
1.9when the child has admitted the allegations contained in the petition before the judge or
1.10referee, or when a hearing has been held as provided for in section 260B.163 and the
1.11allegations contained in the petition have been duly proven but, in either case, before a
1.12finding of delinquency has been entered, the court may continue the case for a period
1.13not to exceed 90 180 days on any one order. Such a continuance may be extended for
1.14one additional successive period not to exceed 90 180 days and only after the court has
1.15reviewed the case and entered its order for an additional continuance without a finding of
1.16delinquency. During this continuance the court may enter an order in accordance with the
1.17provisions of subdivision 1, clause (1) or (2) except clauses (3) and (4), or enter an order
1.18to hold the child in detention for a period not to exceed 15 days on any one order for the
1.19purpose of completing any consideration, or any investigation or examination ordered in
1.20accordance with the provisions of section 260B.157. This subdivision does not apply to an
1.21extended jurisdiction juvenile proceeding.
1.22EFFECTIVE DATE.This section is effective August 1, 2012, and applies to
1.23continuances ordered by the court on or after that date.
