1.1A bill for an act
1.2relating to transportation; traffic regulations; amending brake requirements for
1.3towed implements of husbandry;amending Minnesota Statutes 2010, section
1.4169.801, subdivision 10.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. Minnesota Statutes 2010, section 169.801, subdivision 10, is amended to
1.7read:
1.8    Subd. 10. Brakes. Notwithstanding section 169.67:
1.9    (a) A self-propelled implement of husbandry must be equipped with brakes adequate
1.10to control its movement and to stop and hold it and any vehicle it is towing.
1.11    (b) A towed implement of husbandry must be equipped with brakes adequate to
1.12control its movement and to stop and hold it if:, unless the implement of husbandry is in a
1.13combination of vehicles that meets the requirements of section 169.67, subdivision 5.
1.14    (1) it has a gross vehicle weight of more than 24,000 pounds and was manufactured
1.15and sold after January 1, 1994;
1.16    (2) it has a gross vehicle weight of more than 12,000 pounds and is towed by a
1.17vehicle other than a self-propelled implement of husbandry; or
1.18    (3) it has a gross vehicle weight of more than 3,000 pounds and is being towed by a
1.19registered passenger automobile other than a pickup truck as defined in section 168.002,
1.20subdivision 26

1.21    (c) If a towed implement of husbandry with a gross vehicle weight of more than
1.226,000 pounds, or more than 3,000 pounds if manufactured after January 1, 2011, is
1.23required under paragraph (b) to have brakes, it must also be equipped with brakes adequate
1.24to stop and hold it if it becomes detached from the towing vehicle.
