1.1A bill for an act
1.2relating to transportation; amending certain hours of operation criteria for logo
1.3sign program;amending Minnesota Statutes 2010, section 160.80, subdivision 1a.
1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.5    Section 1. Minnesota Statutes 2010, section 160.80, subdivision 1a, is amended to read:
1.6    Subd. 1a. Eligibility criteria for business panels. (a) To be eligible for a business
1.7panel on a logo sign panel, a business establishment must:
1.8    (1) be open for business;
1.9    (2) have a sign on site that both identifies the business and is visible to motorists;
1.10    (3) be open to everyone, regardless of race, religion, color, age, sex, national origin,
1.11creed, marital status, sexual orientation, or disability;
1.12    (4) not impose a cover charge or otherwise require customers to purchase additional
1.13products or services; and
1.14    (5) meet the appropriate criteria in paragraphs (b) to (f) this subdivision.
1.15    (b) Gas businesses must provide vehicle services including fuel and oil; restroom
1.16facilities and drinking water; continuous, staffed operation at least 12 hours a day, seven
1.17days a week; and public access to a telephone.
1.18    (c) Food businesses must serve at least two meals a day during normal mealtimes
1.19of breakfast, lunch, and dinner; provide a continuous, staffed food service operation at
1.20least ten hours a day, seven days a week except holidays as defined in section 645.44,
1.21subdivision 5
, and except as provided for seasonal food service businesses; provide
1.22seating capacity for at least 20 people; and possess any required state or local licensing or
1.23approval. Seasonal food service businesses must provide a continuous, staffed food service
1.24operation at least ten hours a day, seven days a week, during their months of operation.
2.1    (d) Lodging businesses must include sleeping accommodations, provide public
2.2access to a telephone, and possess any required state or local licensing or approval.
2.3    (e) Camping businesses must include sites for camping, include parking
2.4accommodations for each campsite, provide sanitary facilities and drinking water, and
2.5possess any required state or local licensing or approval.
2.6    (f) 24-hour pharmacy businesses must be continuously operated 24 hours per day,
2.7seven days per week, and must have a state-licensed pharmacist present and on duty at
2.8all times.
2.9    (g) Seasonal businesses must indicate to motorists when they are open for business
2.10by either putting the full months of operation directly on the business panel or by having a
2.11"closed" plaque applied to the business panel when the business is closed for the season.
2.12    (h) The maximum distance that an eligible business in Anoka, Carver, Dakota,
2.13Hennepin, Ramsey, Scott, or Washington County can be located from the interchange is:
2.14for gas businesses, one mile; for food businesses, two miles; for lodging businesses and
2.1524-hour pharmacies, three miles; and for camping businesses, ten miles.
2.16    (i) The maximum distance that an eligible business in any other county can be
2.17located from the interchange shall not exceed 15 miles in either direction, except the
2.18maximum distance that an eligible 24-hour pharmacy business can be located from the
2.19interchange shall not exceed three miles in either direction.
2.20    (j) The commissioner may grant a waiver from the minimum hours per day of
2.21operation required under paragraph (b) or (c), as appropriate, for a business establishment
2.22that otherwise complies with the requirements of that paragraph. The hours per day of
2.23operation for a business under the waiver may not be fewer than half of the hours required
2.24under paragraph (b) or (c), as appropriate.
2.25(k) Logo sign panels must be erected so that motorists approaching an interchange
2.26view the panels in the following order: 24-hour pharmacy, camping, lodging, food, gas.
2.27    (k) (l) If there is insufficient space on a logo sign panel to display all eligible
2.28businesses for a specific type of service, the businesses closest to the interchange have
2.29priority over businesses farther away from the interchange.
2.30EFFECTIVE DATE.This section is effective the day following final enactment.
