1.1A bill for an act
1.2relating to public safety; motor vehicles; providing a weight limit exception
1.3for portable toilet service vehicles;amending Minnesota Statutes 2012, section
1.4169.87, subdivision 6.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. Minnesota Statutes 2012, section 169.87, subdivision 6, is amended to read:
1.7    Subd. 6. Recycling and garbage vehicles. (a) Except as provided in paragraph (b),
1.8weight restrictions imposed under subdivisions 1 and 2 do not apply to a vehicle that
1.9does not exceed 20,000 pounds per single axle and is designed and used exclusively for
1.10recycling, while engaged in recycling in a political subdivision that mandates curbside
1.11recycling pickup.
1.12(b) Weight restrictions imposed under subdivisions 1 and 2 do not apply to: (1) a
1.13vehicle that does not exceed 14,000 pounds per single axle and is used exclusively for
1.14recycling as described in paragraph (a), or; (2) a vehicle that does not exceed 14,000
1.15pounds per single axle and is designed and used exclusively for collecting mixed
1.16municipal solid waste, as defined in section 115A.03, subdivision 21, while engaged
1.17in such collection; or (3) a portable toilet service vehicle that does not exceed 26,000
1.18pounds per single axle and is designed and used exclusively for collecting liquid waste,
1.19while engaged in such collection.
1.20(c) Notwithstanding section 169.80, subdivision 1, a violation of weight restrictions
1.21imposed under subdivisions 1 and 2 by a vehicle designed and used exclusively for
1.22recycling while engaged in recycling in a political subdivision that mandates curbside
1.23recycling pickup while engaged in such collection, or by a vehicle that is designed and
1.24used exclusively for collecting mixed municipal solid waste as defined in section 115A.03,
2.1subdivision 21
, while engaged in such collection, or by a portable toilet service vehicle
2.2that is designed and used exclusively for collecting liquid waste, while engaged in such
2.3collection, is not subject to criminal penalties but is subject to a civil penalty for excess
2.4weight under section 169.871.
2.5EFFECTIVE DATE.This section is effective the day following final enactment.
