1.1A bill for an act
1.2relating to public safety; clarifying that an inmate convicted for assaulting
1.3a correctional officer must serve their sentence consecutive to the sentence
1.4for which they are imprisoned;amending Minnesota Statutes 2010, section
1.5609.2232.
1.6BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.7    Section 1. Minnesota Statutes 2010, section 609.2232, is amended to read:
1.8609.2232 CONSECUTIVE SENTENCES FOR ASSAULTS COMMITTED BY
1.9STATE PRISON INMATES.
1.10If an inmate of a state correctional facility is convicted of violating section 609.221,
1.11609.222 , 609.223, 609.2231, or 609.224, while confined in the facility, the sentence
1.12imposed for the assault shall be executed and shall run consecutively, not concurrently,
1.13to any unexpired portion of the offender's earlier sentence. The inmate is not entitled to
1.14credit against the sentence imposed for the assault for time served in confinement for the
1.15earlier sentence. The inmate shall serve the sentence for the assault in a state correctional
1.16facility even if the assault conviction was for a misdemeanor or gross misdemeanor.
1.17EFFECTIVE DATE.This section is effective July 1, 2011, and applies to offenses
1.18committed on or after that date.
