1.4Minnesota Statutes 2010, section 169.035, subdivision 1.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.6 Section 1. Minnesota Statutes 2010, section 169.035, subdivision 1, is amended to read:
1.7 Subdivision 1. Working on highway. (a) The provisions of this chapter shall not
1.8apply to persons, motor vehicles, and other equipment while actually engaged in work
1.9upon the highway, except as provided in paragraphs (b) and (c).
1.10(b) This chapter shall apply to those persons and vehicles when traveling to or
1.11from such work, except that persons operating equipment owned, rented or hired by
1.12road authorities shall be exempt from the width, height and length provisions of sections
1.13169.80
and
169.81 and shall be exempt from the weight limitations of this chapter while
1.14performing the following actions on behalf of the state or a local governmental unit:
1.15 (1) within 48 hours of the period forecasted to receive snow or ice, while loading,
1.16readying, or moving the equipment in preparation for combating anticipated slippery
1.17road conditions or removing snow or ice;
1.18(2) while actually engaged in snow or ice removaland; or
1.19(3) while engaged in flood control operationson behalf of the state or a local
1.20governmental unit.
1.21(c) Chapter 169A and section169.444 apply to persons while actually engaged in
1.22work upon the highway.
1.23EFFECTIVE DATE.This section is effective the day following final enactment.
