1.1A bill for an act
1.2relating to local governments; aids and credits; reducing future aid payments
1.3for reductions in vital public safety personnel;proposing coding for new law
1.4in Minnesota Statutes, chapter 477A.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. [477A.0137] AID AND CREDIT REDUCTIONS FOR CERTAIN
1.7DECREASES IN PUBLIC SAFETY EMPLOYMENT.
1.8    Subdivision 1. Aid reduction for reductions in public safety complements. If a
1.9city's or a county's certified aid under sections 477A.011 to 477A.03 was reduced due to
1.10an unallotment under section 16A.152 or under another provision of law in the previous
1.11calendar year and its complement of licensed peace officers or its budget for firefighter
1.12compensation is reduced, then the city or county shall lose its aid payment under sections
1.13477A.011 to 477A.03 in the current calendar year. This subdivision does not apply to aid
1.14reductions related to changes in aid amounts that occur under the formulas in sections
1.15477A.011 and 477A.0124, but does apply to reductions related to appropriation reductions
1.16under section 477A.03.
1.17    Subd. 2. Credit reduction for reductions in public safety complements. If a
1.18city's or a county's credit reimbursement under section 273.1384 was reduced due to an
1.19unallotment under section 16A.152 or under another provision of law in the previous
1.20calendar year and its complement of licensed peace officers or its budget for firefighter
1.21compensation is reduced, then the city or county shall lose its credit reimbursement
1.22under section 273.1384 in the current calendar year. This subdivision does not apply
1.23to credit reductions related to reduced reimbursements that occur under the formula in
1.24section 273.1384.
2.1    Subd. 3. Calculating a reduction in licensed peace officers complement or
2.2budget for firefighter compensation. (a) Beginning in calendar year 2012, by the
2.3first working day after March 30 of each year, each city and county shall certify to the
2.4commissioner of revenue the following amounts:
2.5(1) the budgeted full-time equivalent number of licensed peace officers plus the
2.6number of full-time equivalent licensed peace officers provided for in any contract entered
2.7into with another entity for providing police services to the city or county in the previous
2.8calendar year as of January 1 of the previous calendar year;
2.9(2) the actual full-time equivalent number of licensed peace officers employed
2.10directly or indirectly through a contract with another entity that provided police services to
2.11the city or county during the previous calendar year;
2.12(3) the budgeted amount for firefighter compensation of the previous calendar year
2.13either directly or through a contract with another entity to provide firefighting services in
2.14the jurisdiction as of January 1 of the previous calendar year; and
2.15(4) the actual amount spent for firefighter compensation in the previous calendar
2.16year either directly or through a contract with another entity to provide firefighting
2.17services in the jurisdiction.
2.18(b) A reduction in licensed peace officers in the previous year has occurred if the
2.19number reported in paragraph (a), clause (2), is more than ... percent less than the number
2.20reported in paragraph (a), clause (1).
2.21(c) A reduction in the budget for firefighter compensation in the previous year has
2.22occurred if the amount reported under paragraph (a), clause (4), is more than ... percent
2.23less than the amount reported under paragraph (a), clause (3).
2.24EFFECTIVE DATE.This section is effective for aids payable in calendar year
2.252012 and thereafter.
