1.1A bill for an act
1.2relating to education finance; expanding school swimming pool levy to include
1.3small school districts;amending Minnesota Statutes 2010, section 126C.455.
1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.5    Section 1. Minnesota Statutes 2010, section 126C.455, is amended to read:
1.6126C.455 SWIMMING POOL LEVY.
1.7Each year, a school district with its home office located in a county that has (i) a
1.8population density of ten or fewer persons per square mile according to the 2000 census
1.9of population; (ii) an international border; and (iii) more than one school district within
1.10its boundaries, may levy for the net operational costs of a swimming pool. Each year, a
1.11school district with a daily average membership of 3,000 or fewer students may levy for
1.12the net operating costs of a swimming pool. The levy may not exceed the net actual
1.13costs of operation of the swimming pool for the previous year. Net actual costs are
1.14defined as operating costs less any operating revenues and less any payments from other
1.15local governmental units.
1.16EFFECTIVE DATE.This section is effective for taxes payable in 2012 and
1.17thereafter.
