1.1A Senate concurrent resolution
1.2relating to Minnesota's peacetime emergency; terminating the peacetime emergency
1.3pursuant to the authority granted under Minnesota Statutes, section 12.31, subdivision
1.42, paragraph (b).
1.5WHEREAS, Governor Walz signed Executive Order 20-01, a declaration of a peacetime
1.6emergency on March 13, 2020; and
1.7WHEREAS, the Executive Council of the State extended that peacetime emergency for up
1.8to 30 days, on March 16, 2020; and
1.9WHEREAS, on May 13, 2020, by Executive Order 20-55, Governor Walz extended the
1.10peacetime public emergency declared under Executive Order 20-01 and extended in Executive
1.11Order 20-35, until June 12, 2020; and
1.12WHEREAS, the Legislature has appropriated $519,120,000 to help hospitals, clinics, medical
1.13professionals, first responders, and all Minnesotans with the response to the infectious disease
1.14known as COVID-19; and
1.15WHEREAS, the Governor's intentions in declaring a peacetime emergency were honorable,
1.16aiming to save lives and slow the spread of the infectious disease known as COVID-19; and
1.17WHEREAS, the continuation of the executive orders creating a peacetime emergency has a
1.18potential adverse and avoidable consequences for the people of Minnesota; and
1.19WHEREAS, the executive orders will continue to result in the suspension of business activities,
1.20the loss of hundreds of thousands of jobs, and a significant disruption to the state's economic life;
1.21and
1.22WHEREAS, the impact of continuing the Governor's executive orders extends beyond the
1.23economy to the social well-being of Minnesotans, increasing social isolation and the possibility of
2.1increased mental health complications, suicide, drug and alcohol abuse, domestic abuse, and marital
2.2dissolution; and
2.3WHEREAS, the Governor's executive orders are well-intended but potentially harmful to
2.4Minnesotans, arbitrary in their impact, and unlawful in their effects; and
2.5WHEREAS, the House and Senate shall review all executive orders issued during the
2.6peacetime emergency and consider legislation to manage an orderly transition from the peacetime
2.7state of emergency to reestablish freedom of movement and unrestricted commerce in the state of
2.8Minnesota; NOW, THEREFORE,
2.9BE IT RESOLVED by the Senate of the State of Minnesota, the House of Representatives
2.10concurring: that the legislature exercises its authority under Minnesota Statutes, section 12.31,
2.11subdivision 2, paragraph (b), terminating the peacetime emergency declared under Executive Order
2.1220-01, on May 25, 2020.
2.13BE IT FURTHER RESOLVED that the Secretary of the Senate is directed to prepare an
2.14enrolled copy of this resolution, to be authenticated by his signature and those of the Speaker of
2.15the House of Representatives, the Chair of the Senate Rules and Administration Committee, and
2.16the Chief Clerk of the House of Representatives, and transmit it to the Governor of the State of
2.17Minnesota.
