1.1A bill for an act
1.2relating to health; requiring mandatory rabies vaccination for dogs and proof
1.3of vaccination; providing criminal penalties;proposing coding for new law in
1.4Minnesota Statutes, chapter 346.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. [346.535] MANDATORY RABIES VACCINATION.
1.7    Subdivision 1. Requirement for rabies vaccination for dogs. (a) Any person who
1.8owns or is in custody of a dog four months of age or older in the state must have proof that
1.9the dog is currently vaccinated for rabies. Currently vaccinated for rabies means the dog
1.10is vaccinated for rabies according to the Compendium of Animal Rabies Prevention and
1.11Control and is not overdue for a rabies booster vaccination as recommended in Part III
1.12of the Compendium. Proof of rabies vaccination shall be a certified record issued by a
1.13licensed veterinarian according to the Board of Animal Health rules.
1.14(b) The requirement for rabies vaccination for dogs does not apply to a dog currently
1.15confined at a kennel licensed by the Board of Animal Health according to section 347.31
1.16or at an animal facility owned or operated by any political subdivision of the state, or
1.17a dog that has been exempted by the Board of Animal Health based on the written
1.18recommendations of a licensed veterinarian who has examined the dog and has determined
1.19that vaccination is contraindicated due to a medical condition.
1.20    Subd. 2. Enforcement and penalty. Local animal control and law enforcement
1.21officials are responsible for enforcement of this section. A person who violates this
1.22section is guilty of a misdemeanor.
