1.1A bill for an act
1.2relating to transportation; bridges; providing for disposition of remnant steel of
1.3I-35W bridge;proposing coding for new law in Minnesota Statutes, chapter 3.
1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.5    Section 1. [3.7396] DISPOSITION OF REMNANT STEEL OF I-35W BRIDGE.
1.6(a) After completion of the special claims process under section 3.7393 and all
1.7litigation relating to the I-35W bridge collapse, and notwithstanding any provisions in
1.8sections 16C.03, 16C.23, and 161.41, the commissioner of transportation is authorized to
1.9declare as surplus all structural steel and any other materials salvaged from the I-35W
1.10bridge collapse. The commissioner is authorized to distribute, free of charge, pieces of
1.11remnant steel from the bridge to the following persons or institutions in order of priority:
1.12(1) the Minnesota Historical Society;
1.13(2) survivors as defined in section 3.7392, subdivision 8;
1.14(3) federal and state agencies with responsibilities for transportation safety;
1.15(4) institutions of higher education in the field of engineering; and
1.16(5) at the commissioner's discretion, other persons or institutions directly impacted
1.17by the bridge collapse.
1.18(b) The commissioner shall determine the size of the pieces of remnant steel to be
1.19distributed under this section. The commissioner shall complete the process of distributing
1.20pieces of remnant steel within a period of six months from the effective date of this
1.21section. After that time, the commissioner shall dispose of the remaining steel as surplus
1.22property to be melted down and recycled, and the proceeds from such disposal shall
1.23be deposited in the general fund.
2.1(c) The state shall have no liability associated with the condition of the pieces of
2.2remnant steel, including but not limited to the presence of lead-based paint on the steel.
2.3EFFECTIVE DATE.This section is effective the day following final enactment.
