1.1A bill for an act
1.2relating to constitutional parks and trails legacy funding; providing for use
1.3and application of parks and trails funding for Scherer Brothers Lumber Yard
1.4acquisition; amending Laws 2010, chapter 361, article 3, section 7.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. Laws 2010, chapter 361, article 3, section 7, is amended to read:
1.7    Sec. 7. PARKS.
1.8The Minneapolis Park and Recreation Board may acquire all or part of the entire
1.9property known as the Scherer Brothers Lumber Yard for a metropolitan area regional park
1.10and may allocate any future appropriations to the board from the parks and trails fund to
1.11acquire the property. Notwithstanding Minnesota Rules, 6115.0190, subpart 3; 6115.0190,
1.12subpart 5, item E; or 6115.0191, subpart 8, item A; the Minneapolis Park and Recreation
1.13Board is authorized to recreate Hall's Island or such similar island located at approximately
1.14river mile 855 on the Mississippi River, just north of the Plymouth Avenue bridge, at
1.15project site in Sec. 15, T.29 N., R.24 W., Hennepin County, Minnesota, on or adjacent to
1.16the property known as the Scherer Brothers Lumber Yard. The commissioner of natural
1.17resources shall grant any authorizations, permits, or permissions necessary to effectuate
1.18the project, provided that the project is consistent with all other standards and guidelines
1.19in Minnesota Rules, chapter 6115. If the project is not constructed within six years of the
1.20effective date of this act, the authority provided in this section to reconstruct Hall's Island
1.21shall expire. Once recreated, Hall's Island shall remain in public ownership in perpetuity.
1.22EFFECTIVE DATE.This section is effective the day after the Minneapolis Park
1.23and Recreation Board timely completes compliance with Minnesota Statutes, section
1.24645.021, subdivisions 2 and 3.
