1.2relating to education; offering a financial incentive for school boards and teacher
1.3representatives to sign a collective bargaining agreement by January 15 in an
1.4even-numbered year; appropriating money;proposing coding for new law in
1.5Minnesota Statutes, chapter 123B.
1.6BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.7 Section 1. [123B.051] FINANCIAL INCENTIVE TO SIGN COLLECTIVE
1.8BARGAINING AGREEMENT BY JANUARY 15.
1.9 Subdivision 1. Definitions. (a) The following definitions apply to this section.
1.10(b) "Public employer" means:
1.11(1) a district; and
1.12(2) a public employer, as defined by section 179A.03, subdivision 15, other than
1.13a district that (i) negotiates a contract under chapter 179A with teachers, and (ii) is
1.14established by or receives state money or levies under chapters 120A to 129C, 136D,
1.15or 268A.
1.16(c) "Teacher" means a person, other than a superintendent or assistant superintendent,
1.17principal, assistant principal, or a supervisor or confidential employee who occupies a
1.18position for which the person must be licensed by the Board of Teaching, commissioner
1.19of education, the former Board of Technical Colleges, or the Board of Trustees of the
1.20Minnesota State Colleges and Universities.
1.21 Subd. 2. Financial incentive to sign a collective bargaining agreement by
1.22January 15. (a) A district where the public employer and the exclusive representative of
1.23the teachers sign a collective bargaining agreement by January 15 of an even-numbered
1.24calendar year is eligible to receive a state aid payment of $25 times the number of adjusted
1.25pupil units in the district in that fiscal year. A public employer, other than a district,
2.1meeting the requirements of this section is eligible to receive $25 times the number of
2.2adjusted pupil units in programs provided by that employer during the preceding fiscal
2.3year.
2.4(b) The department must determine the number of adjusted pupil units in the
2.5programs and must make education aid payments under this section on a first-come,
2.6first-served basis to the extent such aid is available for this purpose.
2.7EFFECTIVE DATE.This section is effective the day following final enactment.
