1.1A bill for an act
1.2relating to public safety; extending the felony of fraudulent or other improper
1.3finance statements to include retaliation against a sheriff or county recorder for
1.4performance of official duties regarding real property;amending Minnesota
1.5Statutes 2010, section 609.7475, subdivision 3.
1.6BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.7    Section 1. Minnesota Statutes 2010, section 609.7475, subdivision 3, is amended to
1.8read:
1.9    Subd. 3. Penalties. (a) Except as provided in paragraph (b), a person who violates
1.10subdivision 2 is guilty of a gross misdemeanor.
1.11(b) A person who violates subdivision 2 is guilty of a felony and may be sentenced
1.12to imprisonment for not more than five years or to payment of a fine of not more than
1.13$10,000, or both, if the person:
1.14(1) commits the offense with intent to influence or otherwise tamper with a juror
1.15or a judicial proceeding or with intent to retaliate against:
1.16(i) a judicial officer, as defined in section 609.415, or;
1.17(ii) a prosecutor, defense attorney, or officer of the court, because of that person's
1.18performance of official duties in connection with a judicial proceeding;
1.19(iii) a sheriff or deputy sheriff because of that person's performance of official duties
1.20in connection with a sheriff's sale of real property; or
1.21(iv) a county recorder because of that person's performance of official duties in
1.22connection with the filing of liens placed on real property; or
1.23(2) commits the offense after having been previously convicted of a violation
1.24of this section.
2.1EFFECTIVE DATE.This section is effective August 1, 2012, and applies to
2.2offenses committed on or after that date.
