1.2relating to liquor; authorizing purchase in special circumstances;amending
1.3Minnesota Statutes 2010, section 340A.401.
1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.5 Section 1. Minnesota Statutes 2010, section 340A.401, is amended to read:
1.6340A.401 LICENSE REQUIRED.
1.7Except as provided in this chapter, no person may directly or indirectly, on any
1.8pretense or by any device, sell, barter, keep for sale, charge for possession, or otherwise
1.9dispose of alcoholic beverages as part of a commercial transaction without having
1.10obtained the required license or permit. Rental of or permission to use a public facility is
1.11not a commercial transaction for the purposes of this chapter. In the event that an on-sale
1.12or off-sale license has been issued and the state is unable to issue a permit, the license shall
1.13be deemed sufficient to allow purchase until the state is able to issue the necessary permit.
