1.1A bill for an act
1.2relating to energy; biodiesel fuel; exempting certain diesel generators from the
1.3requirement to use biodiesel fuel;amending Minnesota Statutes 2012, section
1.4239.77, subdivision 3.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. Minnesota Statutes 2012, section 239.77, subdivision 3, is amended to read:
1.7    Subd. 3. Exceptions. (a) The minimum content requirements of subdivision 2 do
1.8not apply to fuel used in the following equipment:
1.9    (1) motors located at an electric generating plant regulated by the Nuclear
1.10Regulatory Commission;
1.11    (2) railroad locomotives;
1.12    (3) off-road taconite and copper mining equipment and machinery;
1.13    (4) off-road logging equipment and machinery; and
1.14    (5) vessels of the United States Coast Guard and vessels subject to inspection under
1.15United States Code, title 46, section 3301, subsection (1), (9), (10), (13), or (15).
1.16    (b) The exemption in paragraph (a), clause (1), expires 30 days after the Nuclear
1.17Regulatory Commission has approved the use of biodiesel fuel in motors at electric
1.18generating plants under its regulation.
1.19    (c) The minimum content requirements of subdivision 2 do not apply to Number 1
1.20diesel fuel sold or offered for sale during the months of October, November, December,
1.21January, February, and March.
1.22(d) This subdivision expires May 1, 2015 The minimum content requirements of
1.23subdivision 2 do not apply to diesel fuel used by a company to test and validate the
2.1performance of diesel fuel generators the company has designed and manufactured for use
2.2in jurisdictions where the use of biodiesel fuel is not required.
2.3(e) Paragraphs (a) to (c) expire May 1, 2015.
