1.2relating to natural resources; allowing for lakewide invasive species control on
1.3public waters; exempting lakewide invasive species control from certain permit
1.4fees;amending Minnesota Statutes 2010, section 103G.615, subdivisions 2, 3.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.6 Section 1. Minnesota Statutes 2010, section 103G.615, subdivision 2, is amended to
1.7read:
1.8 Subd. 2. Fees. (a) The commissioner shall establish a fee schedule for permits to
1.9control or harvest aquatic plants other than wild rice. The fees must be set by rule, and
1.10section16A.1283 does not apply, but the rule must not take effect until 45 legislative
1.11days after it has been reported to the legislature. The fees shall be based upon the cost
1.12of receiving, processing, analyzing, and issuing the permit, and additional costs incurred
1.13after the application to inspect and monitor the activities authorized by the permit, and
1.14enforce aquatic plant management rules and permit requirements.
1.15 (b) A fee for a permit for the control of rooted aquatic vegetation for each contiguous
1.16parcel of shoreline owned by an owner may be charged. This fee may not be charged for
1.17permits issued in connection with purple loosestrife control or lakewideEurasian water
1.18milfoil invasive species control programs.
1.19 (c) A fee may not be charged to the state or a federal governmental agency applying
1.20for a permit.
1.21 (d) A fee for a permit for the control of rooted aquatic vegetation in a public
1.22water basin that is 20 acres or less in size shall be one-half of the fee established under
1.23paragraph (a).
2.1(e) The money received for the permits under this subdivision shall be deposited in
2.2the treasury and credited to the water recreation account.
2.3 Sec. 2. Minnesota Statutes 2010, section 103G.615, subdivision 3, is amended to read:
2.4 Subd. 3. Permit standards. The commissioner shall, by rule, prescribe standards to
2.5issue and deny permits under this section. The standards must ensure that aquatic plant
2.6control is consistent with shoreland conservation ordinances, lake management plans
2.7and programs, and wild and scenic river plans. The standards shall allow for lakewide
2.8invasive species control programs.
