1.1A bill for an act
1.2relating to local government; permitting local governments to donate certain
1.3surplus equipment to nonprofit organizations;proposing coding for new law in
1.4Minnesota Statutes, chapter 471.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. [471.3459] DONATION OF SURPLUS EQUIPMENT.
1.7    Subdivision 1. Definitions. For the purposes of this section, the following terms
1.8have the meanings given them:
1.9(1) "local government" means a county, home rule or statutory city, or town;
1.10(2) "nonprofit organization" means an organization formed under section 501(c)(3)
1.11of the Internal Revenue Code; and
1.12(3) "surplus equipment" means cellular phones and emergency medical and fire
1.13fighting equipment that is no longer needed by the local government because it does not
1.14meet industry standards for emergency medical services, police, or fire departments or
1.15has minimal or no resale value.
1.16    Subd. 2. Donation. A local government may donate surplus equipment to one or
1.17more nonprofit organizations. Before the local government makes any donations, it must
1.18adopt a policy on how it will determine what equipment is surplus eligible for donation
1.19and how it will determine which nonprofit organizations may receive donations.
