1.1A bill for an act
1.2relating to human services; modifying the definition of income within the child
1.3care assistance program;amending Minnesota Statutes 2010, section 119B.011, subdivision 15.1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. Minnesota Statutes 2010, section 119B.011, subdivision 15, is amended to
1.7read:
1.8    Subd. 15. Income. "Income" means earned or unearned income received by all
1.9family members, including public assistance cash benefits and at-home infant child
1.10care subsidy payments, unless specifically excluded and child support and maintenance
1.11distributed to the family under section 256.741, subdivision 15. The following are
1.12excluded from income: funds used to pay for health insurance premiums for family
1.13members, Supplemental Security Income, scholarships, work-study income, and grants
1.14that cover costs or reimbursement for tuition, fees, books, and educational supplies;
1.15student loans for tuition, fees, books, supplies, and living expenses; state and federal
1.16earned income tax credits; assistance specifically excluded as income by law; in-kind
1.17income such as food support, energy assistance, foster care assistance, medical assistance,
1.18child care assistance, and housing subsidies; earned income of full-time or part-time
1.19students up to the age of 19, who have not earned a high school diploma or GED high
1.20school equivalency diploma including earnings from summer employment; grant awards
1.21under the family subsidy program; nonrecurring lump-sum income only to the extent that
1.22it is earmarked and used for the purpose for which it is paid; the lesser of $500 or actual
1.23housing-related expenses for families that do not receive housing subsidies; and any
1.24income assigned to the public authority according to section 256.741.
