1.1A bill for an act
1.2relating to traffic regulations; prohibiting saturation patrols and sting operations
1.3to apprehend seat belt violators; requiring POST Board review of agency
1.4compliance;amending Minnesota Statutes 2010, section 169.985.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. Minnesota Statutes 2010, section 169.985, is amended to read:
1.7169.985 TRAFFIC CITATION QUOTA AND CERTAIN SATURATION
1.8PATROLS AND STING OPERATIONS PROHIBITED.
1.9    Subdivision 1. Quotas prohibited. A law enforcement agency may not order,
1.10mandate, require, or suggest to a peace officer a quota for the issuance of traffic citations,
1.11including administrative citations authorized under section 169.999, on a daily, weekly,
1.12monthly, quarterly, or yearly basis.
1.13    Subd. 2. Seat belt violation saturation patrols and sting operations prohibited.
1.14Because seat belt violations do not constitute a hazard to the traveling public, a law
1.15enforcement agency may not conduct a saturation patrol or a sting operation for the
1.16purpose of detecting drivers operating motor vehicles in violation of section 169.686,
1.17subdivision 1, paragraph (a). A saturation patrol is a law enforcement activity during
1.18which enhanced levels of law enforcement are utilized in a concentrated geographic area
1.19for the purpose of detecting a specific violation. A sting operation is a law enforcement
1.20activity designed to utilize deception to detect a specific violation.
1.21    Subd. 3. POST Board review. The Board of Peace Officer Standards and Training
1.22shall include in the reports to the legislature required in section 626.843, subdivision 4,
1.23information on law enforcement agencies' compliance with the prohibitions in this section.
