1.1A bill for an act
1.2relating to education; prohibiting the construction of schools near former
1.3landfills; requiring notice by schools located near former landfills;amending
1.4Minnesota Statutes 2012, section 123B.51, by adding a subdivision.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. Minnesota Statutes 2012, section 123B.51, is amended by adding a
1.7subdivision to read:
1.8    Subd. 1a. School on landfill site; notice. (a) After July 1, 2013, no school may be
1.9constructed within one-quarter mile of land that was used as a landfill.
1.10(b) A school located within one-quarter mile of land that was used as a landfill must
1.11annually provide written notice by regular mail no later than 60 days prior to the beginning
1.12of the school year to parents of all students enrolled at the school and to all employees
1.13who work at the school that states that the school is located within one-quarter mile of
1.14land that was used as a landfill. The notice must include a map drawn to scale depicting
1.15the school grounds and the landfill perimeter. The school must display a link to the notice
1.16and the map on the main home page of its Web site.
1.17    (c) For the purposes of this subdivision:
1.18    (1) "landfill" means a site designed or operated for the purpose of the disposal of
1.19solid waste on or in the land, irrespective of whether the site was issued a solid waste
1.20facility permit by the Pollution Control Agency; and
1.21    (2) "school" means buildings and athletic fields used by students at a school as
1.22defined in section 120A.05, subdivisions 9, 11, 13, and 17.
