1.1A bill for an act
1.2relating to education; allowing school districts to use safe schools levy proceeds
1.3for mental health services and facility modifications designed to enhance student
1.4and staff safety;amending Minnesota Statutes 2012, section 126C.44.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. Minnesota Statutes 2012, section 126C.44, is amended to read:
1.7126C.44 SAFE SCHOOLS LEVY.
1.8    (a) Each district may make a levy on all taxable property located within the district
1.9for the purposes specified in this section. The maximum amount which may be levied
1.10for all costs under this section shall be equal to $30 multiplied by the district's adjusted
1.11marginal cost pupil units for the school year.
1.12    (b) The proceeds of the levy must be reserved and used for directly funding the
1.13following purposes or for reimbursing the cities and counties who contract with the district
1.14for the following purposes: (1) to pay the costs incurred for the salaries, benefits, and
1.15transportation costs of peace officers and sheriffs for liaison in services in the district's
1.16schools; (2) to pay the costs for a drug abuse prevention program as defined in section
1.17609.101, subdivision 3 , paragraph (e), in the elementary schools; (3) to pay the costs for a
1.18gang resistance education training curriculum in the district's schools; (4) to pay the costs
1.19for security in the district's schools and on school property; (5) to pay the costs for other
1.20crime prevention, drug abuse, student and staff safety, voluntary opt-in suicide prevention
1.21tools, and violence prevention measures taken by the school district; or (6) to pay costs
1.22for licensed school counselors, licensed school nurses, licensed school social workers,
1.23licensed school psychologists, and licensed alcohol and chemical dependency counselors
1.24to help provide early responses to problems.; (7) to pay the costs of mental health services,
2.1including services provided by professionals who are not district employees; or (8)
2.2to pay for building security enhancements, including equipment purchases and facility
2.3modifications.
2.4    (c) For expenditures under paragraph (b), clause (1), the district must initially
2.5attempt to contract for services to be provided by peace officers or sheriffs with the
2.6police department of each city or the sheriff's department of the county within the district
2.7containing the school receiving the services. If a local police department or a county
2.8sheriff's department does not wish to provide the necessary services, the district may
2.9contract for these services with any other police or sheriff's department located entirely or
2.10partially within the school district's boundaries.
2.11    (b) (d) A school district that is a member of an intermediate school district may
2.12include in its authority under this section the costs associated with safe schools activities
2.13authorized under paragraph (a) for intermediate school district programs. This authority
2.14must not exceed $10 times the adjusted marginal cost pupil units of the member districts.
2.15This authority is in addition to any other authority authorized under this section. Revenue
2.16raised under this paragraph must be transferred to the intermediate school district.
2.17EFFECTIVE DATE.This section is effective for taxes payable in 2013 and later.
