1.2relating to state government; modifying provisions governing the legislative
1.3auditor;amending Minnesota Statutes 2010, section 37.06; Laws 2010, chapter
1.4361, article 3, section 8.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.6 Section 1. Minnesota Statutes 2010, section 37.06, is amended to read:
1.737.06 SECRETARY; LEGISLATIVE AUDITOR; DUTIES; REPORT.
1.8The secretary shall keep a complete record of the proceedings of the annual meetings
1.9of the State Agricultural Society and all meetings of the board of managers and any
1.10committee of the board, keep all accounts of the society other than those kept by the
1.11treasurer of the society, and perform other duties as directed by the board of managers. On
1.12or before December 31 each year, the secretary shall report to the governor for the fiscal
1.13year ending October 31 all the proceedings of the society during the current year and its
1.14financial condition as appears from its books. This report must contain a full, detailed
1.15statement of all receipts and expenditures during the year.
1.16The books and accounts of the society for the fiscal year must be examined and
1.17audited annually by an independent auditor, either a private auditor or the legislative
1.18auditor. If the audit is conducted by the legislative auditor, the cost of the examination
1.19must be paid by the society to the state and credited to the general fund.
1.20A summary of this examination, certified by thelegislative auditor, must be
1.21appended to the secretary's report, along with thelegislative auditor's recommendations
1.22and the proceedings of the first annual meeting of the society held following the secretary's
1.23report, including addresses made at the meeting as directed by the board of managers. The
1.24summary, recommendations, and proceedings must be printed in the same manner as the
2.1reports of state officers. Copies of the report must be printed annually and distributed as
2.2follows: to each society or association entitled to membership in the society, to each
2.3newspaper in the state, and the remaining copies as directed by the board of managers.
2.4 Sec. 2. Laws 2010, chapter 361, article 3, section 8, is amended to read:
2.5 Sec. 8. USE OF CARRYFORWARD.
2.6The restrictions in Minnesota Statutes, section16A.281 , on the use of money carried
2.7forward from one biennium to another shall not apply to money the legislative auditor
2.8carried forward from theprevious biennium for use in fiscal years 2010 and 2011 ending
2.9June 30, 2009, or the biennium ending June 30, 2011. The legislative auditor may use the
2.10carry forward money for costs related to the conduct of audits related to funds authorized
2.11in the Minnesota Constitution, Article XI, section 15 and audits related to the institutions,
2.12offices, and functions of Minnesota State Colleges and Universities.
2.13EFFECTIVE DATE.This section is effective the day following final enactment.
