1.1A bill for an act
1.2relating to environment; modifying disposition of certain money recovered by
1.3the state;amending Minnesota Statutes 2010, section 115.073.
1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.5    Section 1. Minnesota Statutes 2010, section 115.073, is amended to read:
1.6115.073 ENFORCEMENT FUNDING.
1.7(a) Except as provided in paragraph (b) and section 115C.05, all money recovered by
1.8the state under this chapter and chapters 115A and 116, including civil penalties and money
1.9paid under an agreement, stipulation, or settlement, excluding money paid for past due fees
1.10or taxes, must be deposited in the state treasury and credited to the environmental fund.
1.11(b) All money recovered by the state under this chapter and chapters 115A and 116
1.12from an ethanol plant, as defined under section 41A.09, or a cellulosic biofuel facility,
1.13as defined under section 41A.10, including civil penalties and money paid under an
1.14agreement, stipulation, or settlement, must be deposited in the state treasury and credited
1.15to the general fund.
