AN ACT
To amend chapter 226, RSMo, by adding thereto one new section relating to public roadways.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 226, RSMo, is amended by adding thereto one new section, to be known as section 226.223, to read as follows:
226.223. 1. The department of transportation's plans, programs, and projects shall:
(1) Provide full consideration for the safety and contiguous routes for bicyclists, pedestrians, disabled persons, and transit users of all ages and abilities;
(2) Consider pedestrians as ordinary and accepted users of the state highway system, except in those locations where pedestrians are specifically prohibited;
(3) Consider bicyclists as ordinary and accepted users of the state highway system, except in those locations where bicyclists are specifically prohibited.
2. Bicycle ways, pedestrian ways, and other appropriate accommodations for bicyclists and pedestrians shall be given full consideration in the planning and development of transportation facilities by the department of transportation, including the incorporation of such ways and accommodations into state plans and programs.
3. Consideration of bicycle ways, pedestrian ways, and other appropriate accommodations for bicyclists and pedestrians under subsection 2 of this section shall not be required:
(1) Where sparsity of population or other factors indicate an absence of any need for such ways or accommodations;
(2) Where the cost of establishing such ways or accommodations would be excessively disproportionate to the need or probable use;
(3) Where bicycling is not permitted, consideration of bicycle ways or accommodations is not required;
(4) Where walking is not permitted, consideration of pedestrian ways or accommodations is not required.
4. The department shall establish planning, design, construction, maintenance, and operations standards for appropriate accommodations for bicyclists, pedestrians, disabled persons, and transit users. The department shall establish appropriate training programs for staff to implement these standards.
5. The highways and transportation commission may expend state road fund moneys to provide appropriate accommodations for bicyclists, pedestrians, disabled persons, transit passengers accessing the transit system by bicycling and walking, and other users of the public roadways, in addition to operators of motor vehicles.
