AN ACT

To amend chapter 49, RSMo, by adding thereto one new section relating to the support of public art.




Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapter 49, RSMo, is amended by adding thereto one new section, to be known as section 49.375, to read as follows:

            49.375. 1. Notwithstanding any other provision of law to the contrary, in all charter counties, any county contract for the design, construction, reconstruction, renovation, or remodeling of any county building shall include one percent of the cost estimate for the project to be appropriated and transferred to a public art fund to be established within the county treasury. The estimate shall include engineering and architectural fees, but exclude land acquisition, site demolition, and site preparation. The one percent shall not be applied to any portion of the construction to be completed with private donations.

            2. All charter counties shall establish a public art commission consisting of five members appointed by the county executive, who shall be residents of the county and competent to determine the artistic value of works of art. Two of the members shall be appointed for initial terms of two years and three of the members shall be appointed for initial terms of three years. After the initial appointments, all members shall serve terms of three years. The public art commission shall establish procedures for the submission of public art proposals, the review and selection of projects, and the administration of the county public art fund established within the county treasury. The public art commission shall have the powers and shall perform the duties necessary to implement this section.
