AN ACT

To amend chapter 227, RSMo, by adding thereto one new section relating to the department of transportation utility corridor.




Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapter 227, RSMo, is amended by adding thereto one new section, to be known as section 227.245, to read as follows:

            227.245. 1. The department of transportation utility corridor established for the placement of utility facilities on the right-of-way of highways in the state highway system shall be twelve feet in width with the location to be determined by the highway and transportation commission.

            2. Notwithstanding any provision of law to the contrary, the location, relocation, or maintenance of any utility within the utility corridor or the right-of-way of any highway in the state highway system shall be at the cost and expense of the owner of such utility. No utility owner shall charge or hold the department of transportation or any property owner responsible for any cost or expense associated with the location, relocation, or maintenance of any utility within the right-of-way due to a transportation construction project or improvement meeting department of transportation requirements regardless of who is responsible for the costs of such transportation construction project or improvement.
