AN ACT

To repeal section 21.260, RSMo, and to enact in lieu thereof one new section relating to unexpended appropriations.




Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Section 21.260, RSMo, is repealed and one new section enacted in lieu thereof, to be known as section 21.260, to read as follows:

            21.260. 1. Appropriations for the operation and maintenance of departments shall be separately itemized; and separate appropriations shall be made for each item of extraordinary operation and maintenance expenditure and for each major capital expenditure. Every appropriation law shall distinctly specify the amount and purpose of the appropriation without reference to any other law to fix the amount or purpose.

            2. Except as otherwise prohibited under federal or state law or regulation, any appropriations made under subsection 1 of this section to a state department, agency, or office for ordinary operation and maintenance expenditures for a specific fiscal year which remain unexpended at the end of such fiscal year shall be distributed as follows:

            (1) Twenty-five percent shall be retained by the department, agency, or office and placed into a dedicated fund established by the department, agency, or office for use in addition to any appropriations made to such department, agency, or office in the succeeding fiscal year. Any moneys remaining in such a dedicated fund shall not revert to the credit of the general revenue fund. A detailed accounting of such a dedicated fund shall be available to members of the general assembly upon request;

            (2) Twenty-five percent shall be deposited to the credit of the budget reserve fund established under article IV, section 27(a) of the Constitution of Missouri. Notwithstanding the provisions of section 33.080 to the contrary, the money in the budget reserve fund shall be retained for the purposes specified in article IV, section 27(a) of the Constitution of Missouri and shall not revert or be transferred to general revenue; and

            (3) Fifty percent shall be deposited to the credit of the state general revenue fund.
