AN ACT

To amend chapter 105, RSMo, by adding thereto one new section relating to state employee performance reviews.




Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapter 105, RSMo, is amended by adding thereto one new section, to be known as section 105.930, to read as follows:

            105.930. 1. Any state employee performance review, if conducted, shall be conducted by the employer or supervisor.

            2. As used in this section, the term "state employee" means any person who is employed by the state and earns a salary or wage in a position normally requiring the actual performance by him or her on behalf of the state. As used in this section, "supervisor" shall mean any individual having authority, in the interest of the employer to hire, transfer, suspend, layoff, recall, promote, discharge, assign, reward, or discipline other employees, or responsibility to direct them, or to adjust their grievances, or to recommend such action.
