AN ACT TO PROHIBIT PUBLIC PRIMARY, SECONDARY AND CHARTER SCHOOLS, AS WELL AS PUBLIC POSTSECONDARY EDUCATIONAL INSTITUTIONS, STATE OFFICIALS AND EMPLOYEES OF STATE AGENCIES FROM USING STATE OR PUBLIC FUNDS TO TRAVEL TO OR ENGAGE IN BUSINESS WITH STATES WHICH HAVE ENACTED DISCRIMINATORY RESTRICTIONS UPON ITS CITIZENS AND PUBLICLY FUNDED ENTITIES FROM TRAVELING TO OR DOING BUSINESS WITH THE STATE OF MISSISSIPPI DUE TO THE OPPOSING POSITIONS OF EACH RESPECTIVE STATE WITH REGARD TO THE STATE OF MISSISSIPPI; TO PROVIDE FOR EXCEPTIONS TO THE PROHIBITION; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. (1) Effective immediately upon the passage of this act, except as otherwise provided in subsection (2) of this section, no public primary or secondary school, including a public charter school, which are actively engaged in extracurricular activities regulated by the Mississippi High School Activities Association, nor any public postsecondary educational institution governed by the Board of Trustees of State Institutions of Higher Learning or the Mississippi Community College Board through local community college districts' boards of trustees, which are actively engaged in intercollegiate athletics subject to the rules of the National Collegiate Athletic Association (NCAA), National Junior College Athletic Association (NJCAA) or National Association of Independent Association (NAIA), nor any state official or public employees of state agencies shall expend any public funds for the purpose of traveling to another state to participate in any extracurricular or intercollegiate activities sanctioned by the respective governing bodies for such activities or engaging in business in another state if such state has enacted discriminatory restrictions upon its citizens and publicly funded entities from traveling to or doing business with the State of Mississippi. Neither shall any public primary or secondary school, including a public charter school, any public postsecondary educational institution, or any state agency, department or political subdivision thereof host any event in this state that would require the participation of attendance by any such entities from those restricted states.
(2) Subsection (1) of this section does not apply to travel that is required for:
(a) Enforcement of this state's law;
(b) Litigation;
(c) Compliance with a contractual obligation incurred before the effective date of this act; or
(d) Compliance with a federal government request to appear before a committee or tribunal.
SECTION 2. This act shall take effect and be in force from and after its passage.
