House Bill 1192
AN ACT TO PROHIBIT THE DEPARTMENT OF HUMAN SERVICES FROM REMOVING A STUDENT FROM SCHOOL OR EDUCATIONAL FACILITY WITHOUT FIRST PROVIDING NOTICE OF SUCH REMOVAL TO THE CHILD'S PARENT OR LEGAL GUARDIAN; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. The Department of Human Services, shall be prohibited from removing a student from school without first informing the child's parent(s) or legal guardian. At any time the department deems it necessary in the best interest of a child's health, safety and welfare to remove that child from the custodial home and that child is taken from a school or educational facility before being allowed to return to the custodial home, the department must give the parent or legal guardian notice of the child's removal from the school or educational facility.
SECTION 2. This act shall take effect and be in force from and after July 1, 2013.
