House Bill 1354

AN ACT TO ESTABLISH THE MISSISSIPPI PUBLIC HEALTH TRUST FUND AS A SPECIAL FUND IN THE STATE TREASURY TO BE ADMINISTERED BY THE STATE DEPARTMENT OF HEALTH; TO PROVIDE THAT THE PRIMARY PURPOSE OF THE FUND IS TO ENCOURAGE AND PROVIDE FINANCIAL ASSISTANCE IN THE PROVISION OF PUBLIC HEALTH PROGRAMS AND SERVICES BY THE STATE DEPARTMENT OF HEALTH; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  There is established in the State Treasury a special fund to be known as the "Mississippi Public Health Trust Fund", which shall be administered by the State Department of Health.  The fund shall consist of any monies appropriated to the fund by the Legislature, any donations, gifts and grants from any source, and monies received from any other source that may be hereafter provided by law.

     (2)  The primary purpose of the fund is to encourage and provide financial assistance in the provision of public health programs and services as set forth in Section 41-3-15, and monies in the fund shall be used only for the purposes set forth in Section 41-3-15.

     (3)  Monies in the fund shall be disbursed, upon appropriation of the Legislature, by the State Department of Health with oversight from the State Board of Health.

     (4)  Unexpended amounts remaining in the fund at the end of a fiscal year shall not lapse into the State General Fund, and any interest earned on amounts in the fund shall be deposited to the credit of the special fund.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2025.
