House Bill 1356
AN ACT TO AUTHORIZE THE MISSISSIPPI TRANSPORTATION COMMISSION TO DONATE TO MARSHALL COUNTY CERTAIN EXCESS REAL PROPERTY LOCATED IN MARSHALL COUNTY, MISSISSIPPI; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. (1) The Mississippi Transportation Commission may transfer and convey by mode of donation to Marshall County, all of the rights, title and interest in certain excess real property located within Marshall County, Mississippi, the property being more particularly described as follows:
A 29.11 acres, more or less parcel of land located in the Southeast Quarter (SE ¼) of Section 23, Township 2 South, Range 5 West in Marshall County, Mississippi and being more particularly described as follows:
Commence at the Southeast Corner of Section 23, Township 2 South, Range 5 West in Marshall County, Mississippi; section corner having state plane coordinates of Northing= 1961350.77, Easting= 2489902.03; run thence S 89°29'45" W along the south line of said Section 23 for a distance of 1313.66 feet to the point of beginning of this description; run thence S 89°29'45" W for a distance of 1329.38 feet to a point; run thence N 00°19'00" W leaving said south line of said Section 23 for a distance of 726.26 feet to a point; run thence N 00°02'20" E for a distance of 48.91 feet to a point on the southeast right-of-way line of MDOT Project No. STP-0029-03-(009) (102556/204000); run thence N 75°59'18" E along said southeast right-of-way line for a distance of 433.42 feet to a point; run thence N 66°39'04" E along said southeast right-of-way line for distance of 199.54 feet to a point at the beginning of a circular curve to the left; run thence leaving said southeast right-of-way line along a circular curve to the left for an arc length of 164.10 feet to a point at the end of said curve; said point being again on the said southeast right-of-way line of said project; said curve having a chord bearing of N 66°39'04" E, a chord length of 146.30 feet and a radius of 100.00 feet; run thence N 66°39'04" E along said southeast right-of-way line for a distance of 155.54 feet to a point; run thence S 88°47'42" E along said southeast right-of-way line for a distance of 444.39 feet to a point; run thence S 00°26'44" E leaving said southeast right-of-way line for a distance of 1057.79 feet to the point of beginning, containing 29.11 acres, more or less.
Such property described in the following deeds: Instr. No. 2010005003 (020-0-00-X), Instr. No. 2010003809 (035-0-00-X), Instr. No. 2010004300 (036-0-00-X), Instr. No. 2010003811 (117-0-00-X), Instr. No. 2011000235 (037-0-00-X) as recorded in the Chancery Clerks Office in Holly Springs, Marshall County, Mississippi.
(2) The State of Mississippi shall retain all mineral rights in the property transferred and conveyed by mode of donation under subsection (1) of this section.
SECTION 2. This act shall take effect and be in force from and after its passage.
