AN ACT TO PROVIDE THAT THE DIVISION OF MEDICAID SHALL RECOGNIZE CERTAIN CHILD SUPPORT PAYMENTS AS AN ALLOWABLE COST IF THE BENEFICIARY'S SOLE SOURCE OF INCOME IS FROM THE UNITED STATES SOCIAL SECURITY ADMINISTRATION; TO ALLOW A CREDIT FOR CERTAIN NONCUSTODIAL PARENTS FOR CHILD SUPPORT OBLIGATIONS; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. The Division of Medicaid shall recognize the interception of child support payments from the income of a beneficiary by court order or administrative order of the Department of Human Services as an allowable cost if the beneficiary's sole source of income is a resource check representing a benefit provided by the United States Social Security Administration.
SECTION 2. If benefits are paid to the custodial parent of a child, or account of past-due social security disability benefits paid for on behalf of a child on the record of the noncustodial parent, said noncustodial parent shall be entitled to a credit in the child support obligation due the custodial parent of said child for the entire period for which said payment was received.
SECTION 3. This act shall take effect and be in force from and after its passage.
