AN ACT TO AUTHORIZE THE BOARD OF MAYOR AND COMMISSIONERS OF THE CITY OF CLARKSDALE, MISSISSIPPI, TO CALL A SPECIAL ELECTION FOR THE PURPOSE OF DETERMINING WHETHER THE CLARKSDALE PUBLIC UTILITIES COMMISSION SHOULD BE ABOLISHED UPON RECEIVING THE AFFIRMATIVE VOTE OF 60% OF THE QUALIFIED ELECTORS VOTING IN SUCH SPECIAL ELECTION; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. The Board of Mayor and Commissioners of the City of Clarksdale, Mississippi, is authorized, in its discretion, by resolution, to call a special election for the purpose of determining whether the Clarksdale Public Utilities Commission should be abolished upon receiving the affirmative vote of sixty percent (60%) of the qualified electors voting in the special election held for that purpose.
SECTION 2. In the event that a majority of the electors voting in the special election vote to abolish the Clarksdale Public Utilities Commission, the Board of Mayor and Commissioners of the City of Clarksdale shall assume control and operation of the utilities, thirty (30) days following the certification of the results of the special election.
SECTION 3. This act shall take effect and be in force from and after its passage.
