House Bill 1716

AN ACT TO AUTHORIZE THE GOVERNING AUTHORITIES OF THE CITY OF BILOXI, MISSISSIPPI, TO ACQUIRE OR BUILD INTERNET CAPACITY AND SERVICES FOR USE BY CITY DEPARTMENTS TO MORE EFFECTIVELY DELIVER MUNICIPAL SERVICES TO THE PUBLIC AND TO SELL OR LEASE SURPLUS PROPERTY, CAPACITY AND SERVICES; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  In addition and supplemental to the powers conferred by any other law, the City of Biloxi, Mississippi, acting by and through its governing authorities, who are the mayor and city council, is granted, authorized, and empowered:

          (a)  To acquire by lease or purchase, and/or build, real and personal property for Internet broadband capacity and services  for city departments to more effectively and efficiently deliver municipal services to the public, including, but not limited to, free wi—fi in public buildings and spaces, and to own and operate the city's Internet system and network for the purpose of providing, within a reasonable time as determined by the city, municipal services that rely on the Internet, at broadband speeds of at least one gigabit per second for uploading and downloading digital content on the Internet;

          (b)  To sell or lease, according to general laws for sale or lease of surplus municipal property, any surplus real and personal property pertaining to the city's Internet capacity, services, system, and network to other local governments, public schools, colleges, universities, private businesses, and other third parties, including, but not limited to, the sale or lease of dark fiber and related real and personal property to Internet service providers and any third party for the purpose of accelerating the provision of more accessible, affordable and ubiquitous Internet services to all businesses and residents within the city at broadband speeds of at least one gigabit per second for uploading and downloading digital content on the Internet; and

          (c)  To adopt any and all lawful resolutions, orders and ordinances and do and perform any and all acts and things necessary and requisite to carry out the purposes of this act.

     SECTION 2.  This act shall take effect and be in force from and after its passage.
