AN ACT TO AUTHORIZE THE GOVERNING AUTHORITIES OF THE CITY OF BAY ST. LOUIS, MISSISSIPPI, TO UTILIZE CERTAIN FEDERAL FUNDS AWARDED BY THE FEDERAL EMERGENCY MANAGEMENT AGENCY (FEMA) TO ASSIST WITH FLOOD MITIGATION WITHIN THE CITY; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. As used in this act, the following terms have the meanings ascribed to them in this section unless the context clearly indicates otherwise:
(a) "City" means the City of Bay St. Louis, Mississippi;
(b) "FEMA" means the Federal Emergency Management Agency;
(c) "Funds" means the federal grant monies awarded through the Fiscal Year 2022 Flood Mitigation Assistance (FMA) SWIFT Current grant program; and
(d) "Governing authorities" means the Mayor and the City Council of the City of Bay St. Louis.
SECTION 2. The governing authorities of the City of Bay St. Louis, Mississippi, are authorized, in their discretion, to administer and expend federal grants funds, specifically, Fiscal Year (FY) 2022 Flood Mitigation Assistance (FMA) SWIFT Current funds, which have been awarded by FEMA to assist in flood mitigation.
SECTION 3. The funds, as prescribed under this act, shall be administered and expended by the city for the following projects that are located within the city:
(a) FMA-PJ-04-MS-2022-007 Bay St. Louis SWIFT (3100 Roberson Rd.); and
(b) FMA-PJ-04-MS-2022-008 Bay St. Louis SWIFT (4035 Honshu St.).
SECTION 4. The funds expended by the city shall be utilized solely for flood mitigation, which is in the public interest and the promotion of the public safety, health and welfare of the citizens of the city.
SECTION 5. This act shall take effect and be in force from and after its passage.
