AN ACT TO AUTHORIZE THE DEPARTMENT OF FINANCE AND ADMINISTRATION TO SELL AND CONVEY ALL OR ANY PORTION OF CERTAIN STATE-OWNED REAL PROPERTY IN THE CITIES OF JACKSON, MISSISSIPPI, AND HATTIESBURG, MISSISSIPPI; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. (1) The Department of Finance and Administration is authorized to sell and convey all or any portion of certain state-owned real property, and any improvements thereon, located in the City of Jackson, Hinds County, Mississippi, consisting of approximately twenty-seven and one-half (27-1/2) acres located north of the City of Byram, west of the Interstate 55 - Elton Road Interchange, the deed to which is recorded in Book 1798, Page 409 of the records in the office of the Chancery Clerk of Hinds County, at Jackson, Mississippi, and being more particularly described as follows:
Part of the West Half (W1/2) of the Northeast Quarter (NE1/4) of Section 6, Township 4 North, Range 1 East, and more particularly described as follows:
Beginning at a point on the South line of Elton Road 330 feet measured Easterly along said South line of said road from the point where the same intersects the West line of said W1/2 of NE1/4 and running thence Easterly along the South line of said road for a distance of 1,003 feet to a point where the South line of said road intersects the East line of said W1/2 of NE1/4; thence Southerly along the East line of said W1/2 of NE1/4 for a distance of 1,130 feet to a point, which said point is the Northeast corner of the Anse Moore property; thence West along the North line of the said Anse Moore property for a distance of 990 feet to a point; and
running thence Northerly in a straight line for a distance of 1,306 feet, more or less, to the point of beginning.
This is the same property conveyed to Sam Garner by E. J. Ainsworth, by deed dated December 6, 1943, and recorded in Book 374, Page 377 of the records in the Office of the Chancery Clerk of Hinds County, at Jackson, Mississippi; LESS AND EXCEPT, a parcel described as beginning at a point on the South line of Elton Road, where the same intersects the East line of the W1/2 of the NE1/4 of said Section 6, run thence North 81° 35' West a distance of 531.1 feet to the point of beginning; run thence South 9° 41' West a distance of 150 feet to a point; run thence North 81° 35' West a distance of 50 feet to a point; run thence North 9° 41' East a distance of 150 feet to a point on the South line of Elton Road; and run thence South 81° 35' East a distance of 50 feet to the point of beginning. The excepted parcel is the same property conveyed by Mrs. Eleanor Garner to John W. Rhorer, Jr., and Doris Kate Rhorer, by deed dated December 2, 1963, and recorded in Book 1462, Page 490 in the office of the Chancery Clerk of Hinds County, at Jackson, Mississippi.
(2) In the event that any or all of the real property and improvements described in subsection (1) of this section is sold, the real property shall be sold for not less than the current fair market value as determined by the average of two (2) appraisals by qualified appraisers, one of whom shall be selected by the Department of Finance and Administration, and both of whom shall be certified and licensed by the Mississippi Real Estate Appraiser Licensing and Certification Board.
(3) Any proceeds from the sale of the land, and any improvements thereon, listed in subsection (1) of this section, shall be deposited into the state land acquisition fund.
(4) The Department of Finance and Administration may correct any discrepancies in the legal description of the property provided in this section.
(5) The state shall retain all mineral rights in the property.
SECTION 2. This act shall take effect and be in force from and after July 1, 2017.
