House Bill 660
AN ACT TO CREATE NEW SECTION 73-11-75, MISSISSIPPI CODE OF 1972, TO PROVIDE THAT WHEN A FUNERAL ESTABLISHMENT HAS PICKED UP A BODY AND HAS PERFORMED EMBALMING SERVICES OR OTHER SERVICES IN PREPARING THE BODY FOR BURIAL OR CREMATION, AND THE PERSON WHO IS THE NEXT OF KIN OR AUTHORIZING AGENT OR REPRESENTATIVE OF THE DECEASED REQUESTS THAT THE BODY BE TRANSFERRED TO ANOTHER FUNERAL ESTABLISHMENT FOR BURIAL OR CREMATION, THE TRANSFEREE FUNERAL ESTABLISHMENT MUST FIRST PAY THE TRANSFERRING FUNERAL ESTABLISHMENT FOR THE COST OF THE SERVICES THAT WERE PERFORMED BY THE TRANSFERRING FUNERAL ESTABLISHMENT BEFORE THE BODY MAY BE TRANSFERRED; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. The following shall be codified as Section 73-11-75, Mississippi Code of 1972:
73-11-75. When a funeral establishment has picked up a body and has performed embalming services or other services in preparing the body for burial or cremation, and the person who is the next of kin or authorizing agent or representative of the deceased requests that the body be transferred to another funeral establishment for burial or cremation, the transferee funeral establishment must first pay the transferring funeral establishment for the cost of the services that were performed by the transferring funeral establishment before the body may be transferred.
SECTION 2. This act shall take effect and be in force from and after July 1, 2018.
