AN ACT TO REQUIRE ALL AMUSEMENT RIDE OPERATORS AT THE MISSISSIPPI STATE FAIR TO PASS A DRUG TEST BEFORE THE OPENING DATE OF THE FAIR; TO REQUIRE THE MISSISSIPPI FAIR COMMISSION TO ADOPT RULES AND REGULATIONS GOVERNING THE DRUG TESTING OF AMUSEMENT RIDE OPERATORS; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. (1) As a condition of being employed to operate any amusement ride at the Mississippi State Fair, the Mississippi Fair Commission shall require each person who is to operate an amusement ride at the fair to submit to and pass a drug test administered no less than five (5) days before the opening date of the fair.
(2) The State Fair Commission shall adopt rules and regulations governing the drug testing of amusement ride operators. As an alternative to drug testing by the commission, the rules and regulations may authorize the owner or manager of the amusement rides to submit documentation to the commission verifying that drug testing has been conducted not less than five (5) days before the opening date of the state fair on each person employed to operate an amusement ride. The documentation must include the name of each ride operator, a description of the type of drug test administered to that person, the date of the drug test and the test results.
(3) The cost of a drug test required under this section must be paid by the person who is being tested or the owner or manager of the amusement rides; however, the State Fair Commission, in its discretion, may elect to pay for the cost of the drug test on behalf of any amusement ride operator.
SECTION 2. Section 1 of this act shall be codified as a new section in Article 1, Chapter 5, Title 69, Mississippi Code of 1972.
SECTION 3. This act shall take effect and be in force from and after July 1, 2018.
