AN ACT TO DESIGNATE A SEGMENT OF OLD U.S. HIGHWAY 45 IN ALCORN, PRENTISS AND LEE COUNTIES AS "ROCKABILLY WAY"; TO DESIGNATE A CERTAIN SEGMENT OF MISSISSIPPI HIGHWAY 589 IN LAMAR COUNTY AS THE "POLICE CHIEF WILLIE JAMES PRESTON MEMORIAL HIGHWAY"; TO DESIGNATE A CERTAIN BRIDGE ON MISSISSIPPI HIGHWAY 302 IN DESOTO COUNTY THAT SPANS INTERSTATE HIGHWAY 55 AS "SENATOR GEORGE E. GUERIERI, SR., MEMORIAL BRIDGE"; TO DESIGNATE A CERTAIN SEGMENT OF MISSISSIPPI HIGHWAY 35 WITHIN THE CORPORATE LIMITS OF THE CITY OF BATESVILLE, MISSISSIPPI, AS THE LEONARD MORRIS MEMORIAL HIGHWAY; TO DESIGNATE A PORTION OF UNITED STATES HIGHWAY 82 IN LEFLORE COUNTY AS THE "B.B. KING MEMORIAL HIGHWAY"; TO DESIGNATE A PORTION OF HIGHWAY 8 WEST OF THE TOWN OF PACE AS THE JUNIPER YATES "JY" TRICE MEMORIAL HIGHWAY; TO DESIGNATE A CERTAIN SEGMENT OF U.S. INTERSTATE HIGHWAY 55 IN PIKE COUNTY, MISSISSIPPI, AS THE "BO DIDDLEY MEMORIAL HIGHWAY"; TO DESIGNATE A CERTAIN SEGMENT OF INTERSTATE 220 IN HINDS COUNTY AS THE SENATOR ALICE VARNADO HARDEN MEMORIAL HIGHWAY; TO DESIGNATE A PORTION OF INTERSTATE 220 IN HINDS COUNTY AS THE SENATOR HENRY J. KIRKSEY MEMORIAL HIGHWAY; TO REQUIRE THE DEPARTMENT OF PUBLIC SAFETY TO DEVELOP A PROGRAM ON HOW PERSONS SHOULD RESPOND TO LAW ENFORCEMENT OFFICERS WHEN STOPPED; TO AMEND SECTION 37-25-5, MISSISSIPPI CODE OF 1972, TO REQUIRE DRIVER'S EDUCATION PROGRAMS TAUGHT IN PUBLIC SCHOOLS TO INCLUDE A PROGRAM DEVELOPED BY THE DEPARTMENT OF PUBLIC SAFETY ON HOW PERSONS SHOULD RESPOND TO LAW ENFORCEMENT OFFICERS WHEN STOPPED; TO REQUIRE NONPUBLIC SCHOOLS THAT OFFER A DRIVER'S EDUCATION PROGRAM TO INCLUDE IN SUCH PROGRAM THE PROGRAM DEVELOPED BY THE DEPARTMENT OF PUBLIC SAFETY ON HOW TO RESPOND TO LAW ENFORCEMENT OFFICERS WHEN STOPPED; TO CREATE NEW SECTION 65-9-35, MISSISSIPPI CODE OF 1972, TO AUTHORIZE THE DIVISION OF STATE AID ROAD CONSTRUCTION TO ADMINISTER A CERTAIN BRIDGE REPLACEMENT PROJECT ON MISSISSIPPI HIGHWAY 407 IN ATTALA COUNTY, MISSISSIPPI; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. (1) The segment of Old U.S. Highway 45, also designated as Mississippi Highway 145, in Alcorn, Prentiss and Lee Counties, Mississippi, beginning at the Mississippi-Tennessee state line and extending southerly to its intersection with U.S. Interstate Highway 22, is designated and shall be known as "Rockabilly Way."
(2) The Mississippi Department of Transportation shall erect and maintain appropriate signs along and approaching the segment of highway described in subsection (1) of this section.
SECTION 2. (1) That segment of Mississippi Highway 589 in Lamar County beginning at the Covington/Lamar County line and extending to the intersection of Mississippi Highway 589 and Mississippi Highway 42 is designated and shall be known as the "Police Chief Willie James Preston Memorial Highway."
(2) The Mississippi Department of Transportation shall erect and maintain appropriate signs along and approaching that segment of Mississippi Highway 589.
SECTION 3. (1) That bridge on Mississippi Highway 302 in DeSoto County that spans Interstate Highway 55 is designated and shall be known as the "Senator George E. Guerieri, Sr., Memorial Bridge."
(2) The Mississippi Department of Transportation shall erect and maintain appropriate signs along and approaching the bridge described in subsection (1) of this section.
SECTION 4. (1) That portion of Mississippi Highway 35 within the corporate limits of the City of Batesville, Mississippi, from its intersection with Brewer Road to the point at which it intersects with Interstate Highway 55, is designated and shall be known as the "Leonard Morris Memorial Highway."
(2) The Mississippi Department of Transportation shall erect and maintain appropriate signs along and approaching the segment of highway described in this section.
SECTION 5. (1) That portion of United States Highway 82 in Leflore County from the point of its intersection with Berclair Road to the point of its intersection with Valley of Scholars Boulevard is designated and shall be known as the "B.B. King Memorial Highway."
(2) The Department of Transportation shall erect and maintain appropriate signs along and approaching the segment of highway described in this section.
SECTION 6. (1) That portion of Mississippi Highway 8 beginning at the western corporate limits of the Town of Pace and extending for two (2) miles west of the western corporate limits of the Town of Pace is designated and shall be known as the Juniper Yates "JY" Trice Memorial Highway.
(2) The Department of Transportation shall erect and maintain appropriate signs along and approaching the segment of highway described in this section.
SECTION 7. (1) The segment of U.S. Interstate Highway 55 in Pike County, Mississippi, beginning at exit 20A located in Summit, Mississippi, and extending southerly to exit 13 located in Fernwood, Mississippi, is designated and shall be known as the "Bo Diddley Memorial Highway."
(2) The Mississippi Department of Transportation shall erect and maintain appropriate signs along and approaching the segment of highway described in subsection (1) of this section on both the northbound and southbound lanes.
SECTION 8. (1) That segment of Interstate 220 in Hinds County beginning at the intersection of Interstate 220 and Interstate 20 and extending northerly to Clinton Boulevard is designated and shall be known as the "Senator Alice Varnado Harden Memorial Highway."
(2) The Mississippi Department of Transportation shall erect and maintain appropriate signs along and approaching the segment of interstate described in this section.
SECTION 9. (1) That segment of Interstate 220 in Hinds County beginning at its intersection with Clinton Boulevard and extending northerly to Medgar Evers Boulevard is designated and shall be known as the "Senator Henry J. Kirksey Memorial Highway."
(2) The Mississippi Department of Transportation shall erect and maintain appropriate signs along and approaching the segment of interstate described herein.
SECTION 10. (1) The Department of Public Safety shall develop a program of study on how persons should properly respond when stopped by law enforcement officers to be taught to students as part of the state driver education and training program and as part of a driver education program taught to students attending nonpublic schools.
(2) Any program developed by the Department of Public Safety under this section shall incorporate in that curriculum the constitutional rights that drivers have when encountering a law enforcement officer, including, but not limited to, consent to search and refusal to provide information not pertinent to the traffic stop.
SECTION 11. Section 37-25-5, Mississippi Code of 1972, is amended as follows:
37-25-5. The State Superintendent of Public Education shall prepare and recommend to the State Board of Education, and the board shall adopt rules and regulations governing the establishment, conduct and scope of driver education and training programs in secondary schools of this state, subject to the requirements and exceptions set forth in this chapter. Said program shall be established and maintained only in accordance with such rules and regulations. The state driver education and training program in secondary schools of this state shall include a program of study for alcohol and safety education as it pertains to driver and highway safety and shall also include instruction relating to organ and tissue donation and organ and tissue donation procedures, and shall include instruction on the litter laws of the state and the responsibilities of the driver and all passengers to dispose of litter in the proper container. The state driver education and training program in secondary schools of this state shall also include a program of study, developed by the Department of Public Safety under Section 10 of this act, on how persons should properly respond when stopped by law enforcement officers.
The State Superintendent of Public Education shall prepare an administrative budget from funds made available under this chapter which budget shall be approved by the State Board of Education. It shall be the responsibility of the State Superintendent of Public Education to administer this program in accordance with rules and regulations established by the State Board of Education and to appoint the necessary supervisors of safety education and the necessary clerical personnel.
SECTION 12. Any nonpublic school accredited by the State Board of Education or any other accreditation agency that offers a driver's education program shall include as part of such program the program developed by the Department of Public Safety under Section 10 of this act, related to how persons should properly respond when stopped by law enforcement officers.
SECTION 13. The following shall be codified as Section 65-9-35, Mississippi Code of 1972:
65-9-35. In addition to any authority granted to the Division of State Aid Road Construction in Chapter 9, Title 65, Mississippi Code of 1972, and notwithstanding any general prohibition contained therein with respect to the administration by the division of certain federal funds on designated state highways, the division is authorized and empowered to administer a project utilizing available federal and state funds to reconstruct that portion of designated Mississippi Highway 407 in Attala County, Mississippi, that spans Tibby Creek in Section 25, Township 16 North, Range 9 East, jurisdiction for the maintenance of which is, on the effective date of this act, vested in Attala County.
SECTION 14. Sections 1 through 12 of this act shall take effect and be in force from and after July 1, 2017. Section 13 of this act shall take effect and be in force from and after its passage.
