AN ACT TO AMEND SECTION 43-21-325, MISSISSIPPI CODE OF 1972, TO CLARIFY THE DUTIES OF THE DEPARTMENT OF PUBLIC SAFETY'S PLANNING DIVISION; TO DEFINE THE TERM "SECURE FACILITY"; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. Section 43-21-325, Mississippi Code of 1972, is amended as follows:
43-21-325. (1) The Department of Public Safety's Planning Division is authorized to monitor and carry out the provisions of the federal Juvenile Justice and Delinquency Prevention Act of 2002 in the four (4) core protection requirements of the act for the state as follows:
(a) Deinstitutionalization of status offenders;
(b) Separation of juveniles from incarcerated adults;
(c) Removal of juveniles from adult jails and lockups; and
(d) Disproportional minority contact.
(2) If any staff or individual of a secure facility prohibits the Department of Public Safety's Planning Division from fully performing its duties, which includes the monitoring and carrying out of the four (4) core protection requirements that are prescribed in the federal Juvenile Justice and Delinquency Prevention Act of 2002, then such staff or individual shall be guilty of a misdemeanor, and upon conviction shall be punished by a fine of not more than One Thousand Dollars ($1,000.00).
For purposes of this subsection, "secure facility" means any facility that may be used to hold a juvenile pursuant to public authority.
SECTION 2. This act shall take effect and be in force from and after July 1, 2011.
