A CONCURRENT RESOLUTION PROPOSING AN AMENDMENT TO THE MISSISSIPPI CONSTITUTION OF 1890 BY CREATING A NEW SECTION TO PROHIBIT STATE OR LOCAL GOVERNMENT FROM COMPELLING A PERSON TO PURCHASE A HEALTH INSURANCE PRODUCT THAT CONTAINS A PART THAT THE PERSON CAN NEVER USE BECAUSE OF HIS PERMANENT CONDITION OR CIRCUMSTANCE, OR THAT INCLUDES MANDATORY COVERAGE FOR A SPECIFIC CONDITION OR DISEASE IF THE PERSON IS NOT ANATOMICALLY CAPABLE OF BEING IN THAT CONDITION OR HAVING THAT DISEASE; AND FOR RELATED PURPOSES.
BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI, That the following amendment to the Mississippi Constitution of 1890 is proposed to the qualified electors of the state:
Amend the Mississippi Constitution of 1890 by creating a new section to read as follows:
"Section___. The State of Mississippi, or any local governing authority or governmental entity thereof, may not compel, directly or indirectly, any person who is a citizen of the state to purchase a health insurance product that contains a part that the person can never use because of his permanent physical or other condition or circumstance, or that includes mandatory coverage for a specific condition or disease if the person is not anatomically capable of being in that condition or having that disease."
BE IT FURTHER RESOLVED, That this proposed amendment shall be submitted by the Secretary of State to the qualified electors at an election to be held on the first Tuesday after the first Monday of November 2014, as provided by Section 273 of the Constitution and by general law.
BE IT FURTHER RESOLVED, That the explanation of this proposed amendment for the ballot shall read as follows: "This proposed constitutional amendment prohibits state or local government from compelling a person to purchase a health insurance product containing a part or coverage that the person can never use."
