AN ACT TO RATIFY, CONFIRM AND VALIDATE THE CONVEYANCE OF REAL PROPERTY IN MARION COUNTY BY THE DEPARTMENT OF HUMAN SERVICES TO THE MARION COUNTY ECONOMIC DEVELOPMENT DISTRICT IN 2011; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. (1) The conveyance of the real property described in subsection (2) of this section by the Mississippi Department of Human Services to the Marion County Economic Development District under the authority of Executive Order No. 2011-001 executed by Don Thompson, Executive Director of the Department of Human Services, on April 13, 2011, and the special warranty deed dated May 3, 2011, from the Department of Human Services to the Marion County Economic Development District, is ratified, approved, confirmed and validated. The special warranty deed appears in the land deed records in the Office of the Chancery Clerk of Marion County, Mississippi, in Book 1663 at pages 99 through 104, and Executive Order No. 2011-001 appears in the land deed records in the Office of the Chancery Clerk of Marion County, Mississippi, in Book 1663 at pages 105 through 107. (2) The real property is more particularly described as follows:
Tract 1:
All the part of the N 1/2 of the NW 1/4 of the NE 1/4 of Section 34, Township 4 North, Range 18 West, Marion County, Mississippi, lying South of Highway No. 44.
Tract 2:
The S 1/2 of the NE 1/4 of Section 34, Township 4 North, Range 18 West, Marion County, Mississippi, LESS AND EXCEPT the NE 1/4 of the SE 1/4 of the NE 1/4.
Tract 3:
The N 1/2 of the SE 1/4; the SW 1/4 of the SE 1/4; and the S 1/2 of the SW 1/4; all in Section 34, Township 4 North, Range 18 West, Marion County, Mississippi, LESS AND EXCEPT that portion of the SW 1/4 of the SW 1/4 heretofore conveyed unto the City of Columbia, Mississippi, by Special Warranty Deed dated July 22, 2009, and of record in Book 1610, at page 44, of the land deed records as contained in the office of the Chancery Clerk of Marion County, Mississippi, and more particularly described as follows, to wit:
Commencing at the intersection of the North right of way of National Guard Road with the East right of way of Mississippi Highway No. 44 in the SW 1/4 of the SW 1/4 of Section 34, Township 4 North, Range 18 West, Marion County, Mississippi, and thence run North along the said East right of way line of Mississippi Highway No. 44 a distance of 950 feet, more or less, to an existing fence; thence run in an Easterly direction along side fence a distance of 450 feet, more or less, to the intersection of a fence running North and South; thence run South along said second fence a distance of 950 feet, more or less, back to the North right of way of National Guard Road; thence run in a Westerly direction along the said North right of way of said National Guard Road a distance of 450 feet, more or less, and back to the point of beginning; said exception containing 10 acres, more or less and being located in the SW 1/4 of the SW 1/4 of Section 34, Township 4 North, Range 18 West, Marion County, Mississippi.
Tract 4:
The NW 1/4 of the SW 174 of Section 35, Township 4 North, Range 18 West, Marion County, Mississippi. Containing in the aggregate, 370 acres, more or less.
(2) The State of Mississippi shall retain any mineral rights to the property that was transferred under this section.
SECTION 2. This act shall take effect and be in force from and after its passage.
