AN ACT TO AMEND SECTION 47-7-37.1, MISSISSIPPI CODE OF 1972, TO REMOVE ABSCONDING FROM SUPERVISION AS A GROUND FOR REVOCATION OF PROBATION BY THE COURT; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. Section 47-7-37.1, Mississippi Code of 1972, is amended as follows:
47-7-37.1. Notwithstanding
any other provision of law to the contrary, if a court finds by a preponderance
of the evidence * * *
that a probationer or a person under post-release supervision has committed a
felony * * *,
the court may revoke his probation and impose any or all of the sentence. * * *
SECTION 2. This act shall take effect and be in force from and after July 1, 2021.
