Senate Bill 2686
AN ACT TO CREATE DYLAN'S LAW; TO ENACT REQUIREMENTS FOR THE SAFE TRANSPORTATION AND STORAGE OF GASOLINE BY CONSUMERS; TO ENACT SAFETY STANDARDS; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. (1) Statement of legislative findings. Gasoline is an extremely flammable liquid fuel. It should always be handled and stored properly in order to reduce the likelihood of fires and explosions. Personal injuries ranging from first-degree burns to fatalities can result from improper handling and storage practices. Deaths and injuries can result both from ignition of the volatile vapors and from direct aspiration into the lungs or aspiration following vomiting of ingested gasoline.
(2) Gasoline safety cans required. (a) Gasoline safety cans shall be used to carry, dispense and store gasoline in quantities not to exceed five (5) gallons.
(b) Gasoline may not be carried in the trunk of a vehicle, even if it is carried in a gasoline safety can.
(3) Approved gasoline safety cans. (a) Gasoline safety cans shall have a spring-loaded cap that closes the spout automatically when released so that tension in the spring forces the cap closed and provides a leak-proof seal.
(b) The spring-loaded cap shall be designed to lift the cap slightly in the event of excessive internal vapor pressure inside the can so that vapors will be vented at approximately five (5) pounds per square inch internal pressure to prevent the can from rupturing or exploding if it is exposed to excessive outside heat.
(c) The spout shall be equipped with a flame-arrester screen designed to prevent outside fire from reaching the gasoline inside the can such that vapors can burn around the spout but will not permit an internal fire or explosion. This screen must not be removed or damaged.
SECTION 2. This act shall take effect and be in force from and after July 1, 2011.
