AN ACT TO AMEND SECTION 41-149-7, MISSISSIPPI CODE OF 1972, TO REMOVE DISTRIBUTOR FROM PROHIBITION OF CERTAIN DISCRIMINATORY ACTIONS RELATED TO ENTITIES THAT ARE PARTICIPATING OR AUTHORIZED TO PARTICIPATE IN THE FEDERAL 340B DRUG DISCOUNT PROGRAM; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. Section 41-149-7, Mississippi Code of 1972, is amended as follows:
41-149-7.
(1) A manufacturer * * * or distributor shall not deny, restrict, prohibit, or otherwise
interfere with, either directly or indirectly, the acquisition of a 340B drug
by, or delivery of a 340B drug to, a pharmacy that is under contract with a
340B entity and is authorized under such contract to receive and dispense 340B
drugs on behalf of the covered entity unless such receipt is prohibited by the
United States Department of Health and Human Services.
(2) A manufacturer * * * shall not interfere with a
pharmacy contracted with a 340B entity.
SECTION 2. This act shall take effect and be in force from and after July 1, 2025.
