Senate Bill 2767
AN ACT TO AUTHORIZE AND DIRECT THE MISSISSIPPI DEPARTMENT OF TRANSPORTATION TO TRANSFER ANY REAL PROPERTY TAKEN BY EMINENT DOMAIN PROCEEDINGS FOR THE DEVELOPMENT OF THE YELLOW CREEK STATE INLAND PORT WHICH IS NOT CURRENTLY BEING USED FOR PORT PROJECT DEVELOPMENT FOR FAIR MARKET VALUE WITH THE ORIGINAL OWNERS OF THE PROPERTY HAVING THE RIGHT OF FIRST REFUSAL; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. The Mississippi Department of Transportation, or other state agency with title, is hereby authorized and directed to sell any real property taken by eminent domain proceedings for the development of the Yellow Creek State Inland Port which is not currently being used for port project area development for fair market value. The original owners of record of the property shall have the right of first refusal to purchase the property.
SECTION 2. This act shall take effect and be in force from and after its passage.
